JBH GLOBAL PRIVACY POLICY

This Global Privacy Policy ("Policy") describes how JB Holding Group, LLC ("JBH"), including its operating names Brandon Mushlin Creative and Nextopoly CRM, collects, uses, stores, processes, discloses, and protects information across all JBH-operated digital systems, websites, domains, subdomains, funnels, directories, forms, quizzes, call tracking tools, CRM instances, mobile applications, advertising systems, and related services ("Services").

By accessing, using, installing, or interacting with any JBH-operated website, the Nextopoly platform, or any JBH-managed digital system, you agree to this Policy.

If you do not agree, you may not use the Services.

1. Who We Are

“JBH” refers to JB Holding Group, LLC, a Missouri limited liability company, operating through:

  • Brandon Mushlin Creative

  • Nextopoly CRM

  • All JBH-owned or JBH-operated websites, funnels, directories, or systems

These entities operate as unified service expressions of JBH.

2. Scope of This Policy

This Policy applies to all information collected through:

  • JBH websites and subdomains

  • The Nextopoly CRM

  • The Nextopoly mobile applications

  • Advertising pages, funnels, and quiz systems

  • Call tracking numbers and communication routing

  • Email, SMS, chat, and internal automation interactions

  • System activity within any JBH-managed platform

  • Any JBH digital property, regardless of who pays for hosting or advertising

This Policy does not apply to:

  • Third-party websites not operated by JBH

  • External systems acting independently of JBH

  • Data practices of clients or partners once data has been transferred to them

By using any JBH-operated system, website, mobile application, platform, or CRM environment, you also agree to the JBH Global Terms of Service and the JBH Client Responsibility, Compliance, and Data Handling Agreement. These documents work together with this Privacy Policy and collectively govern your use of all JBH Services.

3. Information We Collect

JBH collects the following categories of information:

3.1 Information You Provide Directly
  • Name

  • Email address

  • Phone number

  • Address

  • Business information

  • Form submissions

  • Survey responses

  • Uploaded files or attachments

  • User-generated content

  • Messages, notes, comments, or communication content

3.2 CRM and App Interaction Data

To operate the Nextopoly platform and mobile applications, JBH collects:

  • Login timestamps

  • User activity logs

  • Form submission events

  • Automation triggers and workflow activity

  • Call logs, SMS logs, email routing logs

  • Contact updates and communication history

  • Appointment activity and status updates

  • System-triggered events and metadata

  • User navigation and behavioral patterns

3.3 Device & Technical Data

Including:

  • IP address (approximate, not precise)

  • Browser type

  • Device type

  • Operating system

  • App version

  • Diagnostic data

  • Interaction analytics

  • Crash reports (if enabled by Apple/Google infrastructure)

  • Cookies, pixels, and tracking technologies

Information collected through the mobile application may be combined with data collected through JBH websites, funnels, CRM systems, or advertising tools. This cross-platform linking supports account authentication, performance optimization, and consistent user experience across devices.

3.4 Marketing & Advertising Data

JBH may collect data used for:

  • Retargeting

  • Ad measurement

  • Campaign optimization

  • Website personalization

  • Cross-device recognition

JBH may use data from the Services to optimize, measure, and deliver advertising on platforms such as Google, Meta, TikTok, and others. JBH may use hashed or anonymized information to create audience segments, measure performance, or tailor marketing content. JBH does not provide raw personal information to advertising networks unless the user directly submits data through those platforms.

3.5 Regulated Financial Communications

For compliance reasons, JBH collects and may retain:

  • Call recordings (if enabled)

  • Communication logs

  • Timestamped activity

  • Notes and contact history

  • System-triggered compliance logs

This may be required under TCPA, OCC, CFPB, and other regulatory frameworks.

3.6 Prohibited Data

JBH does not accept or process:

  • PHI (Protected / Personal Health Information)

  • HIPAA-regulated medical data

  • Social Security Numbers unless explicitly required by a client’s form

  • Sensitive government IDs unless intentionally provided by you

  • Bank or Financial account numbers unless explicitly submitted by you

  • Sensitive biometric data

  • Government documents unless you voluntarily upload them

4. PHI and HIPAA Compliance

JBH is not a HIPAA-compliant service.
JBH does not sign Business Associate Agreements (BAAs).
Entry of PHI into any JBH system is strictly prohibited.

5. How We Use Your Information

JBH uses collected information to:

  • Provide and operate the Services

  • Maintain CRM functionality

  • Deliver and optimize advertising

  • Diagnose and resolve issues

  • Improve system performance

  • Analyze usage and trends

  • Develop new features

  • Provide customer support

  • Fulfill contractual and legal obligations

  • Enforce our Terms of Service

JBH may use anonymized or aggregated data for research, analytics, platform improvement, reporting, and industry insights.

JBH processes data under the following lawful bases:

These processors act under strict confidentiality and limited-use obligations.

7.2 Business Transfers and Client-Authorized Transfers

JBH may transfer data as part of a merger, acquisition, sale of assets, restructuring, or similar event. In addition, JBH may transmit or make available Client Data to the client, entity, lender, builder, contractor, or organization that directly authorized the use of a JBH-managed website, CRM account, form, system, or funnel for their own business purposes.

When a client or authorized party engages JBH to collect inquiries or communications on their behalf, that party is considered the intended recipient of such data. JBH is not responsible for how any client, contractor, lender, builder, or third-party recipient uses, stores, processes, discloses, or secures Client Data after it is transferred or made available to them through authorized access.

JBH does not monitor, audit, supervise, or control client use of Client Data once delivered or accessible, and assumes no liability for client compliance with privacy, marketing, or consumer-protection laws.

JBH does not sell personal data. Any data transfer described in this section is performed exclusively for the operational purpose of delivering the Services requested or authorized by the client.

7.3 Legal and Compliance Requirements

We may disclose data if required by:

  • Comply with a court order or subpoena

  • Respond to regulatory requests

  • Enforce legal rights

  • Prevent fraud or abuse

  • Protect JBH, clients, or users

8. Cookies and Tracking Technologies

JBH uses:

  • Cookies

  • Local storage

These support login, communications, personalization, analytics, ad-delivery, and retargeting.

9. Data Retention

  • Mobile apps

  • Desktop devices

  • CRM accounts

  • Advertising systems

  • Call tracking systems

  • Email and SMS systems

  • Funnels and landing pages

This supports authentication, personalization, and operational continuity.

12. Children's Data

The Services are not intended for children under 13, and JBH does not knowingly collect information from minors.

13. Data Security

JBH uses reasonable safeguards to protect information.
No system is perfectly secure.
You are responsible for maintaining secure credentials.

14. International Data Transfers

Client Data may be stored, processed, or transmitted on servers located in the United States or in other geographic regions, depending on the location of JBH’s technology infrastructure providers. These providers may utilize globally distributed data centers to ensure reliability, performance, and security. By using the Services, you consent to the transfer of information to locations outside your state, province, or country.

15. Changes to This Policy

JBH may update this Policy at any time.
Updates are effective upon posting with a new date.
JBH may notify users but is not required to.
